Who is at fault if a kid loses your cell phone?

My cousin and her husband were at McDonald's. Her husband instructed their kid (a 5 year-old girl) to take care of his cell phone and he'll be right back. He got back in 2 minutes or a bit less and she already lost it.

He thought their daughter could follow easy instructions. He had called his phone call, request the number to be blocked and is in the process of buying a new one. Who is at fault here? Would you blame the kid or not?

When he asked where his cell is, their daughter replied ''I don't know... umm over there''. He was back fast and she already lost his cell.

Ask him if he would have left her alone with $1000 in cash and a notebook with all of his personal information? Because that's exactly what he did, which makes him an idiot. For some reason, people pretend like their phone is a $20 gaming device, and not like the $1000 piece of glass it is, PLUS the portal to all of their most important personal data. I see that stuff ALL THE TIME and I just shake my head.

I knew a girl who literally bought 4 new phones in a month because she kept losing or breaking them, and she STILL was constantly careless with it. She wasn't wealthy, but she didn't seem to be at all bothered by the $1100-1200 cost for each phone, because of course she had to have the top iPhone model.

This exactly. Yet he felt he could trust his daughter with his cell and that she would follow a simple command. Nope, the girl likely got distracted with her toys.
