Why does this guy act differently every time I see him?

So this guy is 21 and I'm 16. yeah I know, he's a creep, I'm stupid. yeah so what, we're not dating.

Earlier when I knew him, I'd basically be a sarcastic bitch. He'd fall up the stairs and I'd be like oh nice move, he'd hit is arm on the door and I'd make a smartass remark.

Later I realized what a bitch I seemed like, so I tried being extra nice the next time I saw him. That's when he started acting like an ass. Now he turned the tables and he's saying all these little comments. And when I got his number and we texted each other one night, he didn't answer me until about a week later randomly saying "can we consummate" The next time I saw him he just acted really awkward and weird. I just don't know what to think because he acts different every time I see him. So since new years is coming up and he's probably going to be at this party I'm going to I don't know if I should just back off.

finishing what I was typing to zuvgwyx, the 21 year old friend won't even talk to a 18 year old he likes because he thinks he's a creep or something. I've known him for probably 5 or 6 years, I don't see him that often though, like once or twice a month.

and just a couple other friends are there, he's all awkward. when the whole gangs there, he doesn't mind talking to me instead of them.

Sounds like he digs you, but feels weird about it. There may be interpersonal tension caused by the age gap (or not), but there are also potential social AND LEGAL consequences for him. It could have been when he texted "can we consimate"[sic], that he had been drinking.

Also, how long have you known him? Is he your big brother's friend? There might be another level of mental awkwardness caused by seeing a bratty kid he knew "all grown up" (but not grown enough).

See if there's a pattern to how he acts toward you. Is he chillier when there are certain people around?

If you two manage to move forward, fer chrissakes, use protection.

He says were friends and w/e but sometimes I feel annoying to him, like when we were texting he was being secretive about it (we were in the same room) and he's like okay you can stop texting me now. and I just kind of thought, well okay jerk so I didn't say anything but then he said something and we kept talking.

I think you're going to have to let this one go, at least for a while. In a couple years, the legal issue will disappear, but the social wrinkle might not. Wrinkles, luckily, can be ironed. Also, by that time he might be more mature and have his act together. I mentioned before that you weren't old enough for him. It seems maybe that HE's the one not old enough. Let the fruit ripen; its rind is still tough and green*.

he's wrong for all kinds of reasons, he quit his job, he is going to school though but took a break from that, he got his liscenses susspended a few times for speeding. He's just an idiot but there's something else about him I can't get my mind off of
