Not all murders are equal either. In what scenario would a rapist believe that the person is giving consent? I'm a little confused by what you meant. The only way it's considered consensual is if the other person says "You can do this to me." Not asking or not getting a reply is not consent.
And even if you're not talking about rape, sexual harassment still isn't okay. A person's body is not your own piece of property that you can touch just because you can see it.

What you’re basically saying is that a person is allowed or partially allowed to commit a crime if the victim makes it easier or more appealing to them. That violates the most basic human rights related to safety.
