Accepting a pardon is an admission of guilt. Afterwards, you're not allowed to plead the fifth with regards to that crime, since you can't incriminate yourself any more. That's why Roger Stone's conviction was upheld, and had his sentence commuted by Trump instead.

That’s, uh, not how the 5th amendment works. Opposing counsel could argue that you should not be allowed to invoke a 5th amendment protection if there was, truly, no possibility of you being charged (anywhere) in the matter. I’m not sure if that argument would be successful or not…. but it has nothing to do with whether you “admitted guilt.”

I’m not sure if you posted the wrong link? There does not seem to be anything there concerning the 5th amendment. It was an article about pardons; so, maybe, something you had looked up for the original question?

Anyway, I’m not clear how pleading guilty revokes the protections of the 5th amendment. I know there is precedent for a 5th amendment plea being disassembled because of an agreement that made prosecution impossible. But I don’t know the precedent for someone who had plead guilty being denied.

If you have the correct link, though, I’d be interested to learn it.

Elsewhere, I've read that if you've got a reasonable concern about a criminal prosecution (perhaps at the state level) stemming from your testimony, you can still invoke the fifth, so yes, you're right on that part.

Because they can, regardless of guilt or innocent... someone could be innocent but think the system is going to get them, someone could be guilty and know its going to get them.

I believe that if they think they are innocent and we’re treated unfairly by the judiciary! A pardon is their last chance at freedom.

I would say they're usually convicted already. But now with Trump and Biden "pre-pardoning" people...

But it still says your guilty. In fact accepting the pardon legally is saying you're guilty.
