I'm not so sure. He could have simply given the documents back when asked in May 2021, but he didn't. The criminal investigation started in March 2022, eight months before he announced.

On the other hand, in the Jan 6 insurrection case, it looks like the DoJ were going to simply go after the footsoldiers, not the people who called them there and sent them to provide cover for the attack on the Capitol. For a year, they basically ignored what was obvious to everyone, until the Jan 6 committee exposed most of what Trump had been up to. Then they had very little choice but to investigate. Ironically, Trump's announcement of his run pushed the investigation out of the hands of the very cautious AG into the hands of a real prosecutor, Jack Smith.

The Georgia case was a long time in the making because it's so huge. I don't think Trump could have stopped that.

1. There was no insurrection or rebellion, Jan 6 was a protest where some people got carried away

2. Trump has never taken "a congressional oath", he has taken a presidential oath

3. The amendment uses the word "should" not "must"

The amendment was written as punishment for Southern States congressmen and senators who supported the Confederacy, to prevent them from getting their seats back. It wasn't uniformly enforced. Many were reelected and took their old seats.

Plenty of video recordings of him sending violent groups to the Capitol and congratulating them as they attacked the police, climbed the walls, broke doors and windows, got inside and trashed offices, stole computers and were trying to get to Pence to drag him to the gallows they had erected. Many witnesses (Republicans) have provided sworn testimony that Trump did in fact say and do those things.
Thousands of people who came unarmed grabbed poles and pieces of fence (which made them armed then) and proceeded to attack police.
DeSantis! What a Joke. Trump praised him and backed him, then switched and has been criticizing him. And Trump is such a moron that he keeps opening his mouth and provides more proof of the charges against him.

Potentially ineligible, the 14th Amendment isn't automatic, these provisions haven't been interpreted, and the 14th Amendment also provides for due process. The final say will be with the Supreme Court.

What you're saying is that some state, like, say, New Mexico, should remove him from the ballot based on his involvement in an insurrection (a New Mexico judge already ruled that it was one when they removed Couy Griffin from office), and see what SCOTUS says about it? That could be interesting.

@goaded It's not a state issue, it's under the federal Constitution. The House of Representatives would have to move to have him declared ineligible to begin the case or controversy, and politically, they wouldn't dare. Also he hasn't been convicted of anything, so none of this even applies.

I think it could be a states' issue. They're required to abide by the federal constitution, and it's the states that run the elections for federal government. They can decide not to put Trump on the ballot (by claiming that he "set on foot" the attack on Jan 6) in which case Trump would have to sue to be on it. (I'm not saying they will, and it's far less likely without a conviction, but it would be a possibility.)
