Saying they're wonderful people is obviously giving comfort (not to mention the fact that they dispersed when he finally told them to).
There's a statute where the bar is just to "set on foot"* an insurrection. My point is that Secretaries of State (or whoever the relevant state authorities are) can cite various laws and declare that Trump was part of the insurrection to remove him from the ballot, forcing him to have to prove that he wasn't part of the insurrection. (I don't think "The "will be wild" tweet wasn't setting the insurrection on foot, we were planning this long before the election even started" would be an acceptable counter!)
I'm not saying it will happen, but I think it could, even before a conviction.

No it is a legitimate question. What is considered an attack on the government? If the Capitol attack is a rebellion, shouldn’t we consider the White House attack a rebellion also? If you are for America then both can be true.
