Looks Like Steven Tyler is Going Down

Recently, plaintiff Julia Misley (née Julia Holcomb) has accused 74 year old Aerosmith frontman Steven Tyler of molesting her as a minor in the seventies. Tyler claims he caught wind of Julia's hard home life and convinced her mother to make him her legal guardian. She got pregnant with his child and threatened to stop supporting her if she didn't abort the pregnancy.

Steven is now being accused of sexual assault of a minor. He faces time in prison and even Disney is retheming their Rock n Roller Coaster because of this. It seems that Steven Tyler is getting canceled now

If he's guilty then he should go to prison and I wouldn't blame Disney for retheming their attraction. But it pisses me off that they are doing it before Tyler was convicted of anything. This is how innocent men's lives get ruined.

Yeah, he should at least be convicted before they retheme their ride. I know he isn't innocent, but he wasn't convicted. Even then, though I wouldn't blame Disney for retheming the rock n roller coaster, but I think the other members of Aerosmith should have a say in this because I don't think their contract is up yet

If he did he did adopt and then molest her as a minor then I don't have a problem with him being jailed - if it can be proven.

It is essential part of the criminal and civil justice systems that a charge can be proven beyond reasonable doubt in criminal cases and on the balance of probabilities in the civil system. I am not a US citizen but the presumption of innocence is a keystone liberty.

It is essential that a defense is possible and that you cannot be guilty because people claim you are. If such a period has elapsed, that people that might have been able to shed light are mostly dead then there is an inherent unfairness to this.

I have noticed that Julia Misley is saying a recent (unspecified) law change has enabled her to take legal action. It is unacceptable that legislation is retrospective because the state can the create crimes that weren't crimes at the time they were committed. I haven't been able to establish what the age of consent was in California at the time.

It is repugnant though that if 50 years ago ago the AoC was say 16 and then in 2022 it is retrospectively made say 18. I dunno what the actual nbrs are by the way. That something was legal in 1975 but not in 2022/3. It is the path to tyranny if the state can retrospectively create new laws you violated 50 years ago.

Now before anybody says anything, I've got runs on the board. I supported a dear friend in obtaining a settlement for a similar issue. I won't say just, because the saying "$5 is too much and $5,000,000 is too little" is entirely true. The lawyer I selected subsequently won "Negotiator of The Year". So I helped a bit along the way.

Nonetheless I support innocent till proven guilty and no retrospective legislation and so would my dear friend.

That's my feeling on my state's legalization of weed. If you are in jail, on trial, or awaiting trial on marijuana charges, then you should be viewed under the laws at the time you committed the offence. You may get released on appeal due to a change in the laws, but you did knowingly violate state law. You shouldn't get a free pass.

@Twalli That's a good point. There is an inverse aspect. Hadn't thought of that. Still it is a lot worse if what you did wasn't a crime at the time but say 50 years on it is made a crime. Dictatorships do that, democracies shouldn't.

Still I guess there is a crime against humanity aspect like with Nazi death camps.

I don't know a lot about the legal system here, but one thing I do know is that all the defense has to do is create reasonable doubt, so Tyler probably won't go to prison, and I looked up the legal age of consent back then, and it went down from 21 to 18 in 1970, so Julia was underage then

Thanks for that confirmation CateM. The US states are so diverse on this. I think in Texas at one point it was 12 ... if she wasn't a virgin. Huh? Maybe I be wrong? Throughout the Anglosphere you are right on reasonable doubt - in criminal cases. In civil it is the balance of probabilities - a very different standard.

So I would guess this will go through the civil system - there is more reward and more pain for the perp.

In the case I am intimately familiar with the perp was silly enough to admit to it to my face. So I could testify to that. He knew it was better to pay up because, where I am, a criminal conviction just makes it easier to launch a civil compensation tort subsequentially.

Nonetheless their needs to be a defense possible. I don't like pedos and I don't like Russian oligarchs.

Nevertheless they can't just be chucked out of a hospital window in yet another Russian smoking accident. Otherwise none of us are safe.

The statute of limitations on this would have passed long ago, so there won't be any criminal charges even if the assertions are true. This lawsuit by this woman under the California 2019 Child Victims Act would have to be a civil lawsuit. She may get some $, but by settling out of court. Tyler, despicable, guilty or not, what this case is about is her, under this act, being able to get money.

What's the worst thing that would happen to Steven Tyler?
He settles out of court - he loses a few million, she gets a few million.

Aerosmith breaks up. Maybe?
Commercial endorsements go away. Maybe?
He doesn't care.
He retires - as a recluse, if he wants - and enjoys his life with $150 million in the bank.
And then, if he feels like being in public again and making a few million more, he gets a million dollar advance and writes with a ghostwriter an autobiography and goes on the talk show and paid-speaker circuit and makes millions more. Of course, Hollywood comes knocking so they can do a biopic although they might wait until he's dead.

there's something to punishment especially when under age, but how wasn't this dealt with long ago?

Well it was the 70s. My own grand mother was legally married at 15, is my grandfather in his 70s going to get arrested.

She got pregnant with his child and he threatened her that he wasn't going to support her and that she would have to get a job just like everyone else.

Just remember at the time at that age you could join the military.
