We keep voting in our guy and then complain about politicians never changing their tune. Gee…I wonder.

that would depend on the actual approach to prosecute...
there is RICO but also... those who liked to throw people off the planes and into the ocean, or halving the members of an assembly with executions so the other pledge loyalty... lol
governments do tend to get quite creative with these approaches, and also with their concepts of "illegal" and also "organization"
and sometimes, you do have three different governments checking on you... just because of your name, or your particular citizenship status, lol...
True, I guess that’s where the defense would come in during the trial. But if say, Antifa or proud boys are declared an illegal organization (unrealistic for many reasons), basically it gives law enforcement more teeth to go after big fish. Like the Jan 6 aholes, who are they…the eyepatch guy is in jail. Forgot their org name…
government tends to go after the big fish... as soon as the government decides they're not longer useful or have overstayed their welcome, not before... lol
That depends on whom and what defines 'membership' The Feds have no ligitimate right whatsoever under the federal constitution as there are no exceptions to the 1st amendment, just as there is little to no such domesic power anyway.
States can do whatever their Constitutions permit however in almost all cases you must establish membership included some kind of action. Otherwise simply being around someone might be regarded as membership and this would violate due process of law.
@OddBeMe I cannot argue against the fact that our 'federal' goverment is lawless.
It is difficult to avoid such organizations when run by any effectively unaccountable lot of power hungry men (politicians).
I can point out that the unauthorized 'powers' claimed by the same effectively unaccountable politicians have been used to abuse far more than the presumed criminals of organized crime.
@OddBeMe What makes a man above the law beyond the fact that he can effectively get away with disregarding it?
As a group Federal politicians in Washington D. C. Answer to nobody on nearly all issues.
They conspire among themselfs to decide what they want to do and hand pick their own judges to rubber stamp it. We the people MAY have some say on only 1 of the countless things they might have done every 2-6 years.
State/local politicians by contrast do in fact answer to judges they didn't hand pick and more importantly we the people can vote at any moment to withdraw our consent with our feet.
State politicians can also be as numerous as the issues they govern and elected as frequently or infrequently as the people deem prudent.
There is very little of what the Federal Goverment now does after 200 years of this effective unaccountably which was ever authorized by we the people under the 11 Page Federal Constitution.
They impoverish every one of us with needless regulations on everything from the design of our homes to what we do with our own body. These powers were stolen from us years and even decades ago and almost nothing can be done peacefully to hold the lawless politicians who did it accountable.
Where are you getting this info from? Can you point me in some direction to your madness? There’s corruption in politics, but the reason most goes unpunished is us. Not them.
Our us vs them mentality sees corrupt shitheads like Clarence thomas’s wife go unpunished, as well as Trump (for now anyway). And Nixon was pardoned for politics which killed Gerald Ford’s career. But still politics.
@OddBeMe your going to have to be more spesfic I get my information form a wide variety of sources.
As for you blaming we the people for not punishing corruption how exactly do you expect us to do that when there are 100+ other issues upon which our 1 vote in every election would otherwise be cast?
The problem with the Federal (and really even state Governments to a lesser degree thanks to the feet vote) is simply the fact that said Goverment doing far too many things for even them to keep track of much less we the people to hold accountable every 2-6 years.
So yes politicians are responsible and largely unaccountable, because instead of just doing a few things they have assumed the power to do everything.
There is a long list of different excuses federal politicians both elected and uneelected have given to impose their rules for our houses. Some I might even agree with, others we know really just an efforts to help secure an unfair advantage to for the company that paid them off.
In either case the problem is not so much the rule but the inherent unaccountable nature of the one who made it. I cannot move to anther state or jurisdiction if I think the cost of the REQUIRED practice outweigh its benefit. Nor can anyone in practice even hold an election on the subject as the same politicians who make (or really didn't make) the rule have 100+ other issues to run on every 2-6 years.
Then why are incumbent politicians so loved? When Congress has a 9% approval rating? Because we love our own firebrands, hate everyone else, and never want to compromise. Which what the founders wanted us to do. Thus Senate vs Congress Vs President.
We keep voting in our guy and then complain about politicians never changing their tune. Gee…I wonder.
@OddBeMe Althou I won't dispute that there is nearly as much political diversity in North America as there is Geographic, cultural, and economic diversity.
The real problem remains the obscuring level of diversity of things those incumbents can cherry pick to run on every time. That we must somehow agree one each and every issue only makes every election more high stakes and bitter in defeat.
Still the fact that said reelection rates did not go too far beyond 50% and reach 90% until congress had acquired the power to buy said votes with the publish treasury in the 1930's New deal does strongly indicate that at least in primaries the power of incumbency directing such money is nearly insurmountable.
I should point out going back 100 years before with the formation of similar local political machines doing similar things had likewise a similarly unaccountable lock on power. A pattern repeated again and again in every late stage democracy in history. Which is why soo many wise men have repeated democracy last until the people discover how to vote themselfs money.
If you wish to reform this system you have to abolish the welfare state, or at the very least deny those on welfare a vote on said welfare. We have the tecnoligy to do the latter at the state level.
It's a RICO predicate, you have to add up a pattern of several to be able to do anything.
Absolutely. in my opinion

Well if your a member of an ilegal organisation well you've committed a crime
We're most SS men punished? Quite a few joined the foreign legions of France and Spain fighting their colonial wars in North africa and Vietnam, New passports, new identities. Some went Argentina
.. some went to train Arab armies fighting Israel.
From what I read, most SS men recruited by the thousands to kill Jews and Slavs or fight in the Waffen SS. A lot of former village cops, hunters, and sometimes convicted criminals went back to regular lives after.
Guys like Klaus Barbie went to Arab armies as consultants, and we recruited a lot of scientists (who were honorary SS). Many wanted men fled to Argentina via illegal Vatican travel documents. Thanks god.
I suppose what we're they going to do with all those SS men. I think only 20% of 900,000 men survived ww2 but still a big number.
That's like saying "is it wrong to punish thieves?"
There is no point in deeming an organization to be illegal unless there's also some consequence for those who join such an organization knowing that it has been deemed illegal.
How else are we going to deal with Labour?
Simples...
If it's banned, I guess so. If the organisation has been involved in illegal activity, maybe.
RICO has been used a lot against the mafia.
