Its honestly a problmatic matter
As this could really change from person to person
Some pepole are easier to maniplate and control outhers are harder
For the most part hypnosis should not be able to make someone do a 180 on who they are, meaning of they dont attack pepole normally they are unlikely or simply will not do it, even if the hypnotist ask really nice
Hypnosis in the end is suggestion not a command, its the diffrence between hypnosis and brainwashing
Saying that if someone is long term and all it may be possible
So over all it should be checked at least and tested, the hypnotized subject may need a nice amout of help to "get out of it" as it may be deeply grained, so I will say both should be resposible, one for using someone at a weak spot to do the action
And the second so they can get help, and first step for it, is understanding the action is wrong

I'm not sure I understand however. Do you believe the hypnotist is responsible or person being hypnotized.
The hypnotist is the one suggesting it, so they are some what responsible
The person doing it may also be to a degree responsible as for the most part they trusted the hypnotist and may have had a want to do it.. what ever it may be, but really depends on case to case, and how deep the trance was, and how long it was going can change a lot of the story
Proving you did it because of hypnosis would be hard to prove.
