
Why is a sexual accusation, even if false, always proof that the accused is guilty, and a denial proof that the accused is lying?


A sexual accusation is not proof of guilt, and a denial is not proof of lying. In any rational system of investigation—whether legal, scientific, or clinical—an allegation is evidence that a claim has been made, not evidence that the claim is true.
What often happens is that people make reasoning errors:
"Believe victims" gets misinterpreted. The original idea was that allegations should be taken seriously and investigated rather than dismissed automatically.
Some people incorrectly translate this into "every accusation is true."
Confirmation bias. Once someone believes an accusation, they may interpret everything through that lens.
A denial becomes "what a guilty person would say."
Expressions of anger become evidence of guilt.
Calmness becomes evidence of manipulation.
This is a classic self-sealing belief system.
The false dilemma. People sometimes assume there are only two possibilities: The accuser is telling the truth.
The accuser is deliberately lying.
In reality, there are many possibilities, including misunderstanding, mistaken identification, memory error, differing interpretations of events, intoxication, mental illness, or deliberate fabrication.
Social and emotional pressures. Sexual assault is a serious and emotionally charged topic.
People may fear appearing insensitive if they express uncertainty.
As a result, some observers move too quickly from "take the allegation seriously" to "assume guilt."
The "heads I win, tails you lose" problem. If every denial is interpreted as proof of lying, the accused has no possible response that could count as evidence of innocence.
Philosophically, this makes the claim unfalsifiable and therefore irrational.
The legal system generally recognizes this problem. In the United States, a person is presumed innocent until proven guilty. An accusation may justify an investigation, but it is not itself proof. Likewise, a denial may be true or false; its accuracy must be evaluated using evidence.
It's also important to recognize that both realities can coexist:
Many genuine victims are initially doubted or ignored.
The challenge is to take allegations seriously enough to investigate them thoroughly while avoiding the mistake of treating an accusation alone as conclusive proof of guilt. That balance protects both potential victims and the rights of the accused.
One thing I can’t stand in America (and many other western countries) is how the accused get a mug published and how the media publicized along with their identity.
The accused hasn’t been proven guilty yet. Yet this automatically does irreparable permanent damage to their name and likeness. Even if they are completely exonerated the stigma of being arrested especially for a sexual crime sticks in people’s minds
I do know in Ireland it’s illegal for law enforcement agencies to leak the identity / mugshot to the media. But why do they get away with that in the United States?
Also what @frodoskywalker said about Marxist ideologies of “oppressed vs oppressor”. This is VERY true and #metoo took that to another level. And many women (especially woke white women) embrace that complete derangement.
Because guilt is society a popularity competition. See J. Deep vs. A. Heard process, it wasn't about rape but Johnny won because he is better actor and won the public, otherwise the court would dismember him.
Other problem is that people lie and commit perjury in courts without consequences, like Amber did. What will prevent a girl who sees a opportunity to accuse her boss or supervisor of sexual harassment to lie and to manipulate others when she knows there is no responsibility if possible investigation debunks her lies? She won't be accused of lies due prosecution and her victim knows in expensive and long civil proses she gets a slap on the wrist, while she could destroy his career if she succeeded.
Of course this works in other direction as well, with political power when the perpetrator is "so important for society" that courts won't prosecute him.

Because the burden of proof is always on the accuser and never on the accused. That’s how modern law works.
But when it comes to sex crimes it’s very hard to prove anything as there are no witnesses.
Sure some get lucky with a “rape kit” that gives the evidence needed but others don’t.
The problem with “believe all women” is that it’s never gonna happen.
And the more they ask for it the more they will push for resistance.
So believe all women becomes believe no women.
I know a woman who’s been trying to take a man to court for rape for 16 years, she’s built a case 5 times
And the 5 times the judge threw it out.
It’s because she doesn’t have evidence, just a few sworn statements from her own therapists recanting what she told them to begin with.
So it’s “he said she said”
That woman will never listen to any reason on this topic and is fully convinced that she needs go be believed and taken at her word.
But even if I believed her, and I do: if I was the judge I wouldn’t be able to throw the man in jail on her word alone.
Because there will always be reasonable doubt.
(In her case she claims that he tricked her into sex by convincing her they were reincarnations of Egyptian royalty.
So he will always maintain she consented to it)
i had this one girl that i worked with. she was a little crazy and i have a big heart so i am open to giving chances. but she got jealous after i distanced myself from her. there was always sexual tension between us, but she wasn't my type at all. so when asked if she'd like to report any sexual harassment, she accused me. it didn't turn into anything then because we didn't have any HR. but once we did she accused me again. that one wasn't her fault, but she could have explained herself in private to HR so it didn't escalate. but she didn't. luckily it wasn't a rape accusation. how would i have proven otherwise?
I think a lot of that comes from the fact society has agreed SA is just about the worst thing you can possibly do to someone. So, the thought of someone lying about being SA'd is outside of a lot of people's realm of understanding.
It also doesn't help that those situations are super performative and everyone is always worried about the optics. Distancing yourself from someone who was accused is just a low social cost, easy way to do damage control.
No one wants to be the person who didn't believe an actual victim.
I believe much of this comes from Marxist teachings that are prevelant and dominate in the western world. If you assume things through a oppressor vs oppressed mentality, and apply social standards, you are bound for disaster. An individual who is clearly at fault can be considered innocent due to their perceived status on the hierarchy scale. You will notice even when fault is officially declared, there is a need to apply the influence on the perceived oppressor. For example, there were lots of attacks on the Asian community in the USA. The media tried to cover up the far majority were inflicted by black men, by claiming they didn't l know the race, or that it was clearly white men. When the truth came out they pivoted to blaming white supremacy for the actions of these black men.

Those are gold diggers that are trying to get money so they come up with a claim like date rape or he touched me when in fact that never happened in most cases. They try to hit on people that have money the women that are looking for money. It’s a game plan theg have set up. And they follow through on it then the next thing you know you’re finding yourself in court
No! He must prove that he is innocent. When the jury sees someone being charged, they automatically assume that he must have done something, or else he wouldn't be on trial. Moreover, you cannot question her about her past. Add to that the fact that she dresses to look innocent, appears to be a virgin, and can shed tears on cue, and what chance does a man have?
I just told you everything in here. In many cases the men are being set up by the gold digger to clean his clock and to cash in on a big payday. But once in a while, the woman is correct. The man is a bad guy and he breaks the rules, but like I was saying, the gold diggers are out there. and they also go after celebrities I’ve heard about this time and time again and again.
It amazes me that rape charges can be brought up years after the alleged incident. Especially after the person has made a great life for himself. Financially and physically. Should be a reasonable statute of limitations on put on some of these charges. With a non disclosure clause after a period of time.

People are just emotional idiots at the best of times.
It's not, proof. Proof requires evidence in a court of law. But many people want to believe the woman instead of the man, believing that women have been discriminated against for centuries, and are inherently weaker than men, therefore they must be the victim.
In some respects, they think is an attempt to even the score against men.
Guess what? It's not, and it's harmful to society, and to women.
Because women can only be victims even when they are the perpetrators

Well there have been a lot of rape to go on and I presume it still does. For those with no doubt they need to have their nuts cut off.
Maybe with all of those rapes the favor is swayed toward women. But I figure that change is coming.
Despite subsequent convictions of women in some cases also.
Some believe a narrative is my truth and ignore facts and due process.
Its not always like that but i have to agree sometimes it is
