You send what you think the worth is, they send what they think the worth is. If you don't agree, you say why, then they send people to appraise the property and they negotiate.
At that level, they skip straight to the appraisal after the initial valuation.
Both parties push the numbers as far into their favor as possible.
What this judge is doing is essentially making it so that the insurance companies can make up whatever number they want and the property owner can loose everything if the insurance company doesn't like it... Or even if they do like it but a politician doesn't.
It's just as O'Leary said. This thing that Trump was on trial for is such a common practice that they'd have to go after pretty much everyone who has sold their home.
I don't think he will ever face any consequences though.

You have to understand that a lot of those types of people genuinely believe that if something were amiss, the system would catch it. So from Jon's logic, if Trump were actually doing what Jon did, NY wouldn't have pursued him. The fact NY did pursue Trump MUST mean that something else happened there.
The problem is... the system is extremely broken and abusive. Jon has spent a number of years developing a brand around being a better alternative to Trump. And the idea that Trump and Jon did the exact same thing is an extremely mind-fucky thing for a guy like Jon to process.

That's actually easily explained:
Madoff was in a criminal litigation and had a personal bond to ensure his appearance (and this was a very high personal bond for a non-violent offender).
Trump is in a civil litigation and has to post bond to enter the appellate court level, while ensuring the funds are secured to pay an eventual judgment. These are totally different parts of the law and can't be compared at all.
But it's not a punishment at all, it's a procedure for the appellate process. There is a blind automatism behind it, without any individual decision. It looks harsh for sure, but I have been told, NY has harsh business laws for a very long time.
Mate, I can't give you law school lectures even if just for the simple fact that I am no jurist myself. But the legal situation is not complicated: These NY laws are the valid and applicable laws and the grand jury, judge and law clerks get to apply them. There were no extra laws invented and no special traps set for Trump! If you find these laws too harsh (I could agree on that) you have to campaign for changes in the state legislature etc.
I certainly agree that this could be a case of selective prosecution and to lose that impression AG James better shows investigations of other real estate firms or she might be voted out of her job for being biased. But that's to be determined.
The main judicial mishandling, so to speak, is through the legal incompetence and lack of experience from Alina Habba, though. I would bet that a smart lawyer would have gotten a FAR better deal with the prosecution and avoided the whole trial completely. Trump's current set of lawyers are mostly kooks and goofs.
@DryGermanGuy Grand juries are convened to determine whether or not there's going to be a criminal trial in a criminal investigation. Grand juries are rarely convened for civil matters.
Also, Trump's legal representation doesn't matter. The cases in New York are nonsensical lawfare. None of them were ever going to be settled out of court.

I have heard several jurists/lawyers comment on the various details and none described the cases as "nonsensical" or "lawfare", they mentioned a certain political taint on them, which I would agree to. But there was no lex Trump invented to take him out of the presidential race or something like that.
They all mentioned the quality of Trump's legal representation often as abysmal, though.

He responds as a comedian, what else? He is not running a science, education or law channel. I am not a jurist or even an American and I understood the legal basis for his NY real estate deal and the complete legality of it just by reading goaded's link and similar responses.

The taxable value as assessed by a governmental agency property appraiser is just a mechanism to establish what proportion of the total area property tax bill the owner should pay, not what a purchaser is expected to pay for it (and it's usually years or decades between re-assessments).
