My question may stir up some people badly so be cautious ⚠️ if you hate prostitutes.

If a girl is hired to provide certain services to a client (group of people) and the girl clearly stated no bondage and no violence and her employer also communicated the same but in the moment these clients decided to violate the terms and pushed her into hard bondage and physical torture which resulted in something like this and much more..

Can a Sex Worker sue her Client or Employer?

And once they were done and the guys came to pick the girl up and saw her state which she complained about too... the clients accepted they did not honor their terms with this girl and they just paid some extra money and said here's the compensation.

Can this girl sue those clients?

And the worst thing... when she reached back at club and told the whole thing to her boss... he listened her called the client and yelled at him a bit and then he just said well they paid extra for this mistreatment so take all that and have 2 days rest... after some arguments all he said was he will ensure this client doesn't get to treat her this way...

Now who is at fault? Client? Employer? or they both?

Or its just that there's going to be no justice for this...

Let's be clear that you are asking a LEGAL question, and legal questions are often VERY different from MORAL questions - meaning, just because something is "right" does not mean it's "legal." It's important to be able to separate the two.

And being a legal question, it's going to vary a whole lot depending on WHERE this took place, and the laws that are in force in that territory. Those laws are the foundation, but on top of the laws, there is also POLITICS. Sometimes clear violations of the law are not prosecuted for political reasons - reasons as simple as the case looking bad in people's statistics - it doesn't have to have anything specifically to do with the people involved in the action. But that's another common reason: if a politically-connected person violates the law, law enforcement may choose to overlook the violation.

I can't speak for the laws in the UK, because I simply don't understand them well enough, nor do I understand the finer details of the British legal system.

If this happened in the US, anywhere outside of the few counties in Nevada where prostitution is legal, the police would likely do nothing about it, because prostitution is illegal nearly everywhere in the US, so people being harmed in the course of breaking the law is mostly ignored and largely looked at as "karma" for doing something that's against the law in the first place.

In those counties in Nevada where prostitution is legal, there might well be more traction on the issue from law enforcement, but even there, there is political pressure not to look bad, so I suspect that crimes such as this might get swept under the rug so that crime statistics - especially those related to prostitution - don't look bad.

This is the main reason I support the legalization of prostitution: so that the women involved are able to expect protection under the law, and have legal recourses if their rights are violated. As it is now, because prostitutes are considered to be criminals, it's extremely difficult to prosecute a case and win in the US if the plaintiff is a prostitute, especially if that crime took place in the course of an act of prostitution. To me, that's wrong, but it's actually women who are the biggest opponents of legalizing prostitution here.

Work aside they assaulted her severely so they should be arrested and damages awarded to plaintiff.

I think work is work and seeing to peoples needs is work and it’s not easy work if it was it’d be legal. But even if it’s not recognized as work it’s two consenting adults having a certain kind of agreed upon sex with one doing things not consented go by the other. That is illegal.

you can have an agreement whether it’s a job an outing a party a marriage a whatever and they broke it. Plus they straight up beat you. Sex was the agreement not abuse. If I have sex with even a bc and he’s violent I didn’t consent to that.

Here in germany you have better rights and are better protected by bodyguards and the law. Once I have witnessed how two of them beat a client up and sent him to the hospital for mistreating a Sex worker. All I can say is that how much you need to go through just to offer a service for some men who seek for pleasure once in a while. Bad... so bad.

Yes, you should be protected and have rights like anyone else. Why is there something wrong with it? File a lawsuit, note his name and everything and there you go. Or go to your doctor to give you a sick note for a month.

Depends on the location of her place of employment, the place of the gig, and the laws in those areas. If prostitution is legal there, she’s got a strong case. If not, she runs a risk similar to a drug dealer trying to sue when their drugs are stolen. Ell oh ell!
Now, there HAVE been successful lawsuits over similar cases, but it takes a special group of lawyers and attorneys, and a fairly special jury. If she can get some high profile civil rights lawyers interested, she might have a winning case. Unfortunately, most people still perceive prostitutes negatively in the US, at least publicly. And we just don’t really care about justice for people of whom we think very lowly.

I'll preface with, I'm not a lawyer, but it seems that not only was there a breach of the contract, which may be hard to prove and win, but there was bodily harm, which is assault.

Since admission of the contract breach was forthcoming and monetary damages were offered, paid and accepted by all parties, then I think suing for breach of contract may fail.

However, the sex worker certainly had an expectation not to be assaulted and injured and put in fear for her life. So I believe the crime would be easier to convict and win despite the higher threshold required to establish guilt.

A sex worker should be fully protected under law, particularly against assault, sbuse etc that wasn't part of the agreed service.

There also needs to be a more focused clamp down on pimps too, I watched interviews on YouTube where girls ran away from home at young age and these predators basically raped them and Imprisoned them and pimped them. The girls handed over every penny to pimp, yet were brainwashed into thinking it was a great job.

She is working for him and she got injured so it is her boss and the clients fault. Her boss basically said "Oh sorry you got injured on the job." but depending on the country, she can sue him for even running a sex work if sex work/prostitution is illegal.

Id say it really comes down to the fine print of the like contract you signed. >.> And if you signed like a do not sue me paperwork which basically you already signed away the right to sue. If somehow your boss didn't have piles of paperwork to hold you accountable then yeah go ahead and sue. But just know it isn't gonna change the fact that like everyone is gonna be aware of your profession if you do sue XD.

It depends on the exact terms. Some places this kind of sex work is illegal (assuming it's not were you are), so I would take it up with your employer as they are liable, you can definitely sue both as this is just plain assault at this point! I hope whoever this is, is ok!!

Had much less scenario than this... employee sexually imposed on by another employee, won $250k 30 years ago. So today, that be several million.

Even prostitution is consensual. If she said yes to sex but no to BDSM and he tied her up and beat her anyway that's criminal sexual assault and battery.

In most countries prostitution is illegal. Even so, decent cops still treat the girl as a human being. It's just a matter of finding the decent cops.

The UK and USA have dedicated departments for sex crimes. That's not an employment issue unless she's making porn.

It depends on local laws. If prostitution is illegal, that would make it much more difficult or even impossible to file a tort claim for intentional infliction of emotional distress, false imprisonment, battery and probably also assault. But it seems to me that criminal charges would be most appropriate in such a case.

I don't know about suing based on a breach of agreement, since any agreement predicated on illegal sex work would be thrown out of any courtroom. But I'd think they could make the case for assault since an act of violence was carried out without the sex worker's consent. But I'm no lawyer, so my opinion really means nothing here.

I don’t know what the laws are where you are but I think you should have a right to sue.

If according lawsuits would say physical harm only if agreed, then suing the client sounds reasonable. I mean if you rent a car, the company would not likely need to tell you to not crash it. If someone seems to not know how sex works, then you can bet he or she missed out on sex-ed in school.

Ian of the opinion that sex work is still work. And therefore they should be able to sue aaded to that I would say that it's the fault of the client and employer. The client breached the agreement made and the employer is at fault as it's there responsibility to ensure safety. And with what happened it is assult. Sadly not everyone sees things as I do, and also it is important to note it depends on local laws.

D) it’s just plain assault and if your employer sent you there he’s as liable as the guys who did that to you.
Suing for business reasons won’t get you far if the place you live outlaws your work. If it doesn’t, sure that’s one avenue.

But again, it’s assault, illegal confinement, sexual assault, etc. If you’re wanting to just get money from this I guess threaten police action.

Client knew better and chose to ignore her request and employer failed to remedy situation on the spot to send message it will not be tolerated to any future people who would think about ignoring her request. Her or his body is their lively hood. As far as an actual lawsuit is probably outta the question but so good old street justice isn't.

Just because she is offering sex for the money - doesn't mean the opposite person owns her and treats her the way he wants. Also when its clearly mentioned no certain things allowed then yes she has the right to sue the client and if employer does not support her then sue the employer as well
